These Terms & Conditions (“Terms”) govern your access to and use of ErbiInk.com (the “Site”) and your purchase of products from Erbi Ink LLC (“Erbi Ink,” “we,” “us,” or “our”).
By accessing the Site, creating an account or placing an order, you agree to these Terms, our Privacy Policy and our Return & Refund Policy. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old or the legal age required to enter into a binding agreement where you live to place an order.
A parent or legal guardian may place an order on behalf of a minor. By using the Site, you represent that you have the legal authority to agree to these Terms.
2. Use of the Site
You may use the Site only for lawful personal and commercial-shopping purposes.
You agree not to:
Use the Site for unlawful, fraudulent or deceptive activity
Attempt to gain unauthorized access to the Site, customer accounts or connected systems
Interfere with the Site’s security, performance or operation
Introduce viruses, malicious code or other harmful technology
Copy, scrape, download or reproduce Site content without permission
Use automated tools to extract product, customer or pricing information
Impersonate another person or provide false information
Use Erbi Ink’s artwork, trademarks, photographs or content without authorization
Place fraudulent orders or use unauthorized payment information
We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.
3. Products and Made-to-Order Fulfillment
Many Erbi Ink products are made to order. This means production may begin shortly after an order is submitted.
Product availability displayed as “in stock” may mean that the selected product or blank is currently available for production. It does not necessarily mean that a finished product is being held in physical inventory.
We may use third-party production and fulfillment providers, including Printify and its printing partners, to manufacture and ship orders.
4. Product Descriptions and Images
We make reasonable efforts to present product descriptions, colors, sizes, materials and images accurately.
However:
Colors may appear differently depending on your screen or device
Print placement and sizing may vary slightly between items
Made-to-order products may have minor production variations
Product photographs and digital mockups are provided for representation
Measurements may vary within normal manufacturing tolerances
Minor color, measurement or print-placement variations that do not affect the reasonable use of a product are not considered defects.
We may correct errors, inaccuracies or omissions in product information at any time.
5. Orders and Order Acceptance
Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received your order but does not guarantee final acceptance.
We may refuse, limit or cancel an order for reasons including:
Product or material unavailability
Incorrect pricing or product information
Suspected fraud or unauthorized payment
An invalid or incomplete shipping address
Technical or production problems
Violation of these Terms or another Erbi Ink policy
Circumstances that make fulfillment commercially or legally impractical
If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.
6. Pricing, Taxes and Promotions
Prices are displayed in U.S. dollars unless otherwise stated.
Prices, discounts, shipping offers and product availability may change without notice. A price change will not affect an order that has already been accepted, except when the displayed price resulted from an obvious technical or listing error.
Applicable taxes and shipping charges are calculated during checkout.
Promotional codes and discounts:
Must be entered before completing checkout
May have expiration dates or eligibility requirements
May be limited to one use per customer or household
May exclude certain products or collections
Cannot be redeemed for cash
May not be combined unless expressly permitted
Cannot be applied retroactively to completed orders
We may cancel or modify a promotion when fraud, abuse, unauthorized sharing or a technical error affects the offer.
7. Payment
Payment must be authorized before an order can be processed.
Payments are handled by third-party payment processors available through our ecommerce platform. By submitting payment information, you represent that:
The information is accurate and complete
You are authorized to use the selected payment method
The payment provider may charge the order total, including taxes and shipping
Erbi Ink does not directly receive or store your complete payment-card number.
If payment is declined, reversed or identified as potentially fraudulent, the order may be delayed or cancelled.
8. Order Changes and Cancellations
Because made-to-order production begins quickly, requests to change or cancel an order must be submitted within 12 hours of purchase.
Email ErbiInk@ErbiInk.com with your order number and requested change.
We will make a reasonable effort to accommodate requests received within 12 hours. However, a change or cancellation cannot be guaranteed if production has already started.
Orders cannot be changed or cancelled after they have entered production or shipped.
If an approved cancellation is processed, the refund will be returned to the original payment method. Financial institutions may require 5–10 business days to post the credit.
9. Production and Shipping
Production and delivery estimates are estimates rather than guaranteed arrival dates.
Production time may be affected by:
Product availability
Order volume
Seasonal demand
Printing or quality-control requirements
Carrier operations
Weather or other events outside our reasonable control
Tracking information will be provided when available.
If we learn that an order cannot be shipped within the timeframe originally stated—or within the period required by applicable law—we will contact you with an updated estimate and any legally required option to accept the delay or cancel the unshipped order for a refund.
10. Shipping Addresses and Delivery
Customers are responsible for providing a complete and accurate shipping address during checkout.
Contact us immediately if you discover an address error. We cannot guarantee that an address can be changed after production or shipping has begun.
If an order is returned because of an incorrect, incomplete or undeliverable address, the customer may be responsible for additional shipping costs before the order is resent.
Delivery estimates may be affected by carriers, weather, customs, holidays and other circumstances outside our reasonable control.
If tracking shows a package as delivered but you cannot locate it, contact us promptly. We may ask you to check with household members, neighbors, the delivery location or the carrier while we help review the available information.
11. International Orders
Products available for international delivery will be identified during checkout.
International customers are responsible for any customs duties, import taxes, brokerage charges or other fees imposed by the destination country unless the checkout page expressly states otherwise.
Customs processing may delay delivery. Erbi Ink cannot control or guarantee customs-processing times.
12. Returns, Replacements and Size Exchanges
Because our products are made to order, we do not accept general returns or provide refunds for buyer’s remorse.
Damaged, Defective or Incorrect Items
If your item arrives damaged, defective, misprinted or incorrect, contact us at ErbiInk@ErbiInk.com within seven days of delivery.
Include:
Your order number
A description of the problem
Clear photographs showing the issue
Qualifying items will receive a free replacement. In most cases, the original item will not need to be returned.
Size Exchanges
Customers may request one size exchange within seven days of delivery.
To qualify:
The item must be unworn
The item must be unwashed
The item must not be altered
The exchange request must be submitted within seven days
Unless otherwise stated, the customer is responsible for return shipping costs associated with a size exchange.
Non-Returnable Items
We do not accept returns, refunds or additional exchanges for:
Buyer’s remorse or change of mind
Additional size changes after the one-time exchange
Items that have been worn, washed or altered
Minor color or print-placement variations
Normal wear and tear
Damage caused by misuse or improper care
Items returned without prior authorization
Approved refunds, when applicable, will be returned to the original payment method. Financial institutions may require 5–10 business days to post the credit.

13. Reviews, Testimonials and Customer Content
You may be able to submit reviews, photographs, comments, testimonials or other content.
By submitting content, you confirm that:
The content reflects your honest experience
You have the right to submit it
It does not violate another person’s rights
It is not knowingly false, misleading or defamatory
It does not contain unlawful, threatening or harmful material
You have disclosed any material relationship with Erbi Ink
Material relationships may include receiving a free product, discount, gift, payment or other incentive. Family members, employees, contractors and others with a personal or business connection to Erbi Ink must clearly disclose that relationship when providing a review or endorsement.
Any review incentive offered by Erbi Ink is for an honest review and is not conditioned on the review being positive.
By submitting content, you grant Erbi Ink a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, display and share that content in connection with our Site, social media, products and marketing.
We may remove content that violates these Terms, but we are not obligated to publish or retain every submission.
14. Intellectual Property
The Site and its content—including the Erbi Ink name, logos, artwork, product designs, graphics, photographs, videos, text and page layouts—are owned by or licensed to Erbi Ink LLC and are protected by applicable intellectual-property laws.
No content may be copied, reproduced, modified, distributed, sold, displayed or used commercially without prior written permission from Erbi Ink.
Purchasing a product does not transfer ownership of the design, artwork or other intellectual property appearing on that product.
You may share public product pages and Erbi Ink social-media content for personal, noncommercial purposes when the content is not altered and the Erbi Ink identity remains visible.
15. Cannabis-Themed Content
Some products and content may contain cannabis-related imagery, humor, language or cultural references.
These elements are provided solely for lawful artistic, cultural and lifestyle expression. Erbi Ink does not sell cannabis, controlled substances or drug-related services.
The presence of cannabis-themed content is not medical, legal or professional advice and should not be interpreted as encouraging unlawful activity.
Customers are responsible for understanding and complying with the laws that apply where they live.
16. Third-Party Services and Links
The Site may use or link to services operated by third parties, including ecommerce, payment, production, fulfillment, shipping, analytics, advertising and social-media providers.
Third-party services operate under their own terms and privacy policies. Erbi Ink is not responsible for the independent content, security or practices of third-party websites and services.
A link to a third-party website does not necessarily represent an endorsement.
17. Privacy
Our collection and use of personal information are described in our Privacy Policy.
By using the Site or placing an order, you acknowledge that information may be processed by service providers that help operate our ecommerce store, process payments, produce merchandise, deliver orders, provide customer support and measure website performance.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the Site and its content are provided on an “as available” basis.
We do not guarantee that:
The Site will always be available or uninterrupted
Every error will be corrected immediately
The Site will be free from harmful components
Every product will meet subjective personal expectations
Product availability will remain unchanged
This section does not limit any warranty or consumer right that cannot legally be excluded.
19. Limitation of Liability
To the maximum extent permitted by applicable law, Erbi Ink LLC will not be liable for indirect, incidental, special, consequential or punitive damages arising from the use of the Site or purchase of products.
Where liability cannot legally be excluded, Erbi Ink’s total liability relating to a specific order will not exceed the amount paid for that order, except where applicable law requires otherwise.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from fraud, intentional misconduct or other non-waivable obligations.
20. Indemnification
To the extent permitted by law, you agree to defend and hold Erbi Ink LLC harmless from third-party claims, damages or expenses resulting from:
Your unlawful use of the Site
Your violation of these Terms
Content you submit
Your infringement of another person’s rights
Fraudulent or unauthorized activity associated with your account
This section does not apply where prohibited by consumer-protection law.
21. Events Outside Our Control
Erbi Ink is not responsible for a delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, carrier disruptions, labor disputes, supply shortages, internet outages, government actions or production-provider interruptions.
This section does not remove any cancellation, refund or other right provided by applicable law.
22. Account Suspension and Termination
We may suspend or terminate an account or restrict access to the Site when we reasonably believe that:
These Terms have been violated
Fraudulent or abusive activity has occurred
The account creates a security risk
Suspension is required by law
Termination does not eliminate payment obligations or other responsibilities arising before termination.
23. Changes to These Terms
We may update these Terms to reflect changes in our products, business practices, service providers or legal obligations.
The updated version will be posted on the Site with a revised “Last Updated” date. Changes apply prospectively from their effective date unless applicable law requires otherwise.
Terms in effect when an order was accepted will generally continue to govern that order.
24. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact us at ErbiInk@ErbiInk.com and make a reasonable attempt to resolve the dispute informally.
If a dispute cannot be resolved informally, it may be brought in a state or federal court with lawful jurisdiction in Pennsylvania, except where applicable consumer law permits or requires a different location.
Nothing in this section prevents either party from bringing an eligible claim in small-claims court or exercising a right that cannot legally be waived.
25. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.
26. No Waiver
If Erbi Ink does not immediately enforce a provision of these Terms, that does not waive the right to enforce it later.
27. Entire Agreement
These Terms, together with the Privacy Policy, Return & Refund Policy and any additional terms presented during checkout, form the entire agreement between you and Erbi Ink regarding the Site and purchases made through it.
